Terms of Service

By using OpenOn, you agree to these terms.

These Terms of Service (“Terms”) are a legal agreement between you and OpenOn (“we,” “our,” or “us”) governing your use of the OpenOn mobile application, our website, and related services (collectively, the “Service”). If you do not agree, do not use the Service.

You must be at least 13 years old to use OpenOn. If you are under 18, you represent that you have a parent or guardian’s permission to use the Service where required by law. You may not use the Service if you are prohibited from doing so under applicable law.

You agree to use OpenOn lawfully and respectfully.

Users must not:

• Harass or abuse others.
• Send harmful or illegal content.
• Misuse anonymous messaging.

You also must not:

• Send spam, scams, malware, or deceptive content.
• Impersonate another person or misrepresent your affiliation.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or others’ accounts.
• Reverse engineer or try to extract source code except where applicable law allows.

You retain ownership of your content, but grant us permission to store and deliver it. Content you create and submit through OpenOn is “Your Content.” You are responsible for Your Content and for having the rights to share it.

License to us. You grant us a worldwide, non-exclusive license to host, store, process, transmit, display, and distribute Your Content solely to operate, provide, improve, and secure the Service — for example, to deliver time-locked letters, send notifications, and back up data. This license ends when Your Content is deleted from our systems, except for reasonable retention as described in our Privacy Policy or as required by law.

Our IP. The OpenOn name, logo, software, and materials we provide are owned by us or our licensors and are protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights.

Anonymous messages are temporary and may reveal sender identity after a defined period (up to three days), as shown in the app. We may process related data as described in our Privacy Policy.

We may suspend or terminate accounts that violate these Terms.

We may also suspend or terminate your access to the Service, or remove content, if we reasonably believe you created risk or harm, or we need to do so to comply with law or protect users. You may stop using the Service at any time. Provisions that by their nature should survive (including ownership, disclaimers, and limitations) will survive termination.

We do not guarantee uninterrupted or error-free service.

We strive to keep OpenOn reliable, but the Service may be unavailable at times. Features may change, be limited, or be discontinued. We may modify or stop all or part of the Service with or without notice, except where applicable law requires otherwise.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT CONTENT WILL BE SECURE OR FREE OF LOSS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENON AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50), EXCEPT WHERE PROHIBITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT ALLOWED.

You will defend and indemnify us and our affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content or your misuse of the Service, except to the extent caused by our willful misconduct.

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless applicable consumer protection laws in your country of residence require otherwise. Courts in Delaware may have jurisdiction, subject to mandatory rights you may have in your home country.

By providing your phone number, you agree to receive SMS messages from OpenOn for authentication and account verification purposes.

Message frequency varies based on your login activity. Message and data rates may apply.

You can reply STOP to opt out of SMS messages at any time or reply HELP for assistance.

We may update these Terms from time to time. We will post the updated Terms in the app and/or on our website and update the effective date. If a change is material, we will provide additional notice where required by law. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those Terms, except where applicable law requires your explicit consent.
